6. Data Retention
We retain personal data for as long as your account is active or as needed to provide services. Account data is deleted within 90 days of account closure upon request. Audit logs are retained for 7 years to comply with legal obligations. Anonymized, aggregated analytics data may be retained indefinitely. Backup data is purged within 180 days of the primary deletion.
7. Third-Party Data Sharing
We share data with: (a) Service providers acting as data processors (cloud infrastructure, payment processors, customer support tools) under strict data processing agreements; (b) Professional advisors (attorneys, auditors) bound by confidentiality obligations; (c) Law enforcement when required by applicable law. We do not sell personal data to third parties. All third-party processors are contractually required to implement appropriate security measures.

Terms of Service

1. Acceptance of Terms
By accessing or using the Onyxlink platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Services.
2. Description of Services
Onyxlink provides a cloud-based SaaS platform for workflow automation, team collaboration, and business analytics. Services are provided on a subscription basis and are subject to the feature set of your selected plan. We reserve the right to modify, suspend, or discontinue features with reasonable notice to subscribers.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorized account access. You agree not to share credentials, use the Services for unlawful purposes, attempt to reverse-engineer the platform, or use automated means to scrape data.
4. Subscription, Billing, and Cancellation
Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as stated in our Refund Policy. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with 30 days' written notice to active subscribers.
5. Intellectual Property
Onyxlink retains all rights, title, and interest in the platform, software, and documentation. You retain ownership of all data and content you submit to the platform. You grant Onyxlink a limited license to process your data solely to provide the Services. You may not copy, modify, or create derivative works of the Onyxlink platform without prior written consent.
6. Service Level Agreement
We target 99.97% monthly uptime for the core platform. In the event of downtime exceeding our SLA thresholds, eligible customers may receive service credits as described in our SLA documentation at onyxlink81.com/sla. Credits are the sole remedy for service unavailability.
7. Limitation of Liability
To the maximum extent permitted by law, Onyxlink's total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid to Onyxlink in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration in San Francisco, California, under AAA Commercial Arbitration Rules, except that either party may seek injunctive relief in court for IP violations.
